Affiliate Program Requirements
To participate in the Program as an Affiliate, you must qualify as follows:
Participants must be at least 18 years old.
An active StaffViz account is not a mandatory requirement.
The program must not be used for illegal or unauthorized purposes and must comply with all applicable laws and regulations.
Links and Referral Codes
You will receive a unique code (“Code”) for single use upon joining. StaffViz will provide you with specific links and HTML code that can be placed on your website, within emails, or other communications to promote StaffViz. To ensure accurate tracking, reporting, and accrual of referral rewards, you must use the special link formats we provided. Only links that utilize these special formats and connect properly from your site to the StaffViz product sites will qualify as "Special Links" and be eligible for credit.
Your Code remains valid as long as you have an active StaffViz
Partner Program subscription. Once your subscription ends, you can no longer participate in the Program, and your Code will expire. You earn referral rewards only when new accounts are created through your affiliate links or when your code is correctly used during the sign-up process. We are not responsible for any lost rewards due to the improper use of links or codes. Affiliate links must be directed to either the StaffViz home page or the pricing page found at www.staffviz.com
Referral Rewards
To earn a referral reward, the new customer must correctly apply your Code during account setup. This can happen manually or automatically through cookies when they use a Special Link. However, no reward is earned if the Code is not applied correctly due to cookie issues (e.g., cookies not accepted, expired, or deleted).
Referral rewards are issued once the customer completes account creation and pays the subscription fee. If the customer cancels their account, charges back, or receives a refund within 120 days of the transaction, any earned reward will be forfeited, and StaffViz may reclaim already credited rewards.
Rewards are only
considered for referrals that our system automatically tracks and verifies through the Code application during account creation. Unverified claims of sign-up or Code usage will not qualify for rewards.
U.S. federal law requires us to collect tax information from U.S. citizens/residents, and those whose businesses are taxable in the U.S. Failure to provide required tax information upon request may result in withholding of your rewards.
We reserve the right to disqualify rewards earned through fraudulent or unethical marketing methods.
Credit of Referral Awards to Your Account
Referral rewards are credited solely to accounts, not individual users. Rewards are forfeited if an account expires due to cancellation or non-payment. Rewards are issued as account credits only; no cash payments are available.
Schedule of Account Accreditation
The first referral payment will be made after 60 days, and subsequent payments will be issued every 30 days thereafter to the PayPal, WISE, Payoneer, or bank accounts to the UAE, USA and Pakistan bank accounts.
Customers
Customers purchasing through this affiliate
program are considered StaffViz customers. All StaffViz rules and policies on orders and services apply to them. StaffViz may change policies and procedures at any time. Due to potential price changes, do not list product prices on your site. StaffViz endeavors to provide accurate product information but cannot guarantee product availability or pricing.
Your Responsibilities
As an affiliate, you must not misrepresent your relationship with StaffViz or imply any unauthorized association. You are solely responsible for your site’s development, operation, and maintenance, including the legality of the content and links displayed. Ensure that displaying Special Links does not breach any third-party agreements.
You are also responsible for the security of your account and password; StaffViz is not liable for losses resulting from security lapses. Additionally, your site must transparently disclose how it collects, uses, stores, and shares visitor data, noting that third parties may also collect information through cookies and advertisements directly from visitors.
Compliance with Laws
As a participant in the Program, you agree to adhere to all local, state, federal, and international laws, regulations, and other legal requirements that apply to you. This commitment includes all laws governing marketing practices, specifically anti-spam laws pertaining to email marketing. Also, all materials displayed on your site must be lawful and not infringe on any third party's rights, including intellectual property, privacy, and proprietary rights.
Term of the Agreement and Program
The term of this Agreement begins when your application is accepted and can be terminated by either you or StaffViz at any time, for any reason, with a written notice of termination. StaffViz may issue a termination notice via email to your registered address. Upon termination, you must immediately stop using all StaffViz links, trademarks, logos, and any other materials provided by or on behalf of StaffViz related to the Program. StaffViz also reserves the right to discontinue the Program at any time.
Termination
StaffViz reserves the right, at its sole discretion, to suspend or terminate your account and deny any current or future use of the Program or any other StaffViz service for any reason at any time. Such action may result in the deactivation or deletion of your account, denial of access to your account, and the forfeiture of any potential or accrued referral rewards if StaffViz deems, at its discretion, that they were obtained through fraudulent, illegal, or questionable sales or marketing methods. StaffViz also reserves the right to refuse service to anyone at any time for any reason.
Relationship of Parties
Participation in the Affiliate Program establishes only an independent affliate partner relationship between you and the StaffViz. This Agreement does not create any form of equity partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties. As an affiliate, you have no authority to make offers or representations on behalf of StaffViz. You must not make any statements on your site or elsewhere that would contradict the terms outlined in this section.
Limitations of Liability
STAFFVIZ'S TOTAL LIABILITY TO YOU, INCLUDING FOR CLAIMS MADE BY ANY THIRD PARTY ARISING FROM YOUR RIGHTS UNDER THIS AGREEMENT OR RELATED TO THE PROGRAM, SHALL NOT EXCEED THE TOTAL REFERRAL REWARDS PAID TO YOU. STAFFVIZ WILL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING BUSINESS INTERRUPTION OR LOSS OF PROFITS, REGARDLESS OF WHETHER IT HAS BEEN ADVISED OF SUCH POSSIBLE DAMAGES.
ALL PROGRAM MATERIALS ARE PROVIDED "AS IS" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. STAFFVIZ DISCLAIMS ALL WARRANTIES, INCLUDING THOSE OF MERCHANTABILITY, FITNESS, AND NONINFRINGEMENT. STAFFVIZ DOES NOT GUARANTEE THE UNINTERRUPTED OR ERROR-FREE OPERATION OF PRODUCT SITES AND WILL NOT BE LIABLE FOR THE CONSEQUENCES OF ANY INTERRUPTIONS OR ERRORS.
BY PARTICIPATING, YOU ACKNOWLEDGE READING AND AGREEING TO THIS AGREEMENT. YOU UNDERSTAND STAFFVIZ MAY SOLICIT CUSTOMER REFERRALS OR OPERATE WEBSITES COMPETING WITH YOURS. YOU HAVE CHOSEN TO PARTICIPATE IN THE PROGRAM BASED ON YOUR OWN EVALUATION AND NOT ON ANY REPRESENTATIONS OUTSIDE THIS AGREEMENT.
Indemnity
You agree to defend, indemnify, and hold harmless StaffViz and its officers, directors, employees, and agents from any claims, actions, or demands, including reasonable legal and accounting fees, arising from (I) the development, operation, maintenance, or content of your site; (ii) breach of this Agreement; (iii) your misrepresentation of StaffViz products or services.
Arbitration
Any disputes related to this Agreement, your activities, or your relationship with StaffViz shall be submitted to confidential arbitration in the jurisdiction where StaffViz's headquarters are located. However, if you violate or threaten to violate our intellectual property rights, StaffViz may seek legal relief in any state or federal court or any other competent court. Arbitration will follow the current rules of the American Arbitration Association. The arbitrator's decision will be final and enforceable in any court of competent jurisdiction. No arbitration shall be joined with any other proceeding under this Agreement.
Press Releases
You are not permitted to issue any press releases about your participation in the Program without prior written approval from StaffViz. You grant StaffViz the right to use your trade name and logo on its website.
Amendment to Terms
StaffViz may modify the Program and this Agreement at any time without prior notice. Updates will be posted on the StaffViz website, and continued participation after changes indicates your Agreement. Regularly check the StaffViz website for updates.
Miscellaneous
This Agreement is governed by Delaware law, regardless of conflict of laws principles. You cannot assign this Agreement without StaffViz's written consent. This Agreement is binding and enforceable by both parties and their successors. Non-enforcement of any terms by StaffViz does not waive enforcement of that or any other term. Any provision invalid under applicable law will be adjusted to reflect the parties' intentions, and the remaining provisions will stay in effect. Headings are for convenience only and do not affect interpretation. This Agreement is the complete Agreement between you and StaffViz
regarding your participation in the Program.
